Litigation: Defending Labor Organizations In Court And Before Administrative Agencies

Defense of unions under federal, state and local laws: We defend labor unions in all aspects of labor and employment litigation, including matters arising under the National Labor Relations Act (NLRA), the Labor Management Relations Act (LMRA), the LMRDA, Title VII of the Civil Rights Act of 1964, and similar state and local laws.

We defend our union clients against all manner of labor and employment claims, including breach of the duty of fair representation, unfair labor practice charges, discrimination (including disparate impact), breach of contract, challenges to completed or ongoing union elections, and challenges to union trusteeships.

We have successfully defended our labor clients in jurisdictions throughout the country. We have won cases before the Supreme Court of the United States, various federal courts of appeal, district courts, state courts and administrative agencies.

NLRB proceedings: We have decades of collective experience providing legal advice and representation to labor unions when it comes to issues involving the National Labor Relations Board (NLRB), including defending them at trial.

EEOC proceedings: Our attorneys regularly defend our clients against charges of discrimination and retaliation.

Collective Bargaining, Negotiations, Organizing And Internal Union Affairs

Contract negotiation and collective bargaining: Our firm has union knowledge and decades of experience in the maritime longshore industry. Combined with negotiating experience, we have the experience to help our labor clients resolve challenging bargaining situations. We work with unions to help them achieve agreements that provide for long-term protection for their union membership.

Contract and grievance arbitration: Our firm has helped resolve a multiple number of grievances. We are committed to helping resolve union grievances in the most cost-efficient manner possible. We are skilled at handling negotiations on behalf of union members.

LMRDA compliance: The Labor-Management Reporting and Disclosure Act (LMRDA) establishes rights for union members and is designed to promote democratic procedures within labor organizations. We can help ensure compliance with the LMRDA and handle any litigation matters related to the LMRDA.

Officer election compliance: We work with international and private sector local unions to ensure that their elections for union officers comply with their union constitutions and the requirements of the LMRDA. Our attorneys are well-versed to identify potential problems and how to defend against legal claims challenged by the DOL.

We also assist our union clients to ensure that they meet their DOL reporting requirements, including LM-2 obligations, trusteeship filings, annual reports and dues objectors.

Organizing: We have extensive experience assisting unions with organizing employees, including representing unions before the National Labor Relations Board during the certification process.

Department of Labor investigations and audits: We provide legal counsel in all matters pertaining to federal, state, and local administrative and regulatory agency investigations and audits.

Internal investigations and hearings: We help conduct internal union investigations in cases concerning suspected fraud, corruption and other matters. We also provide legal counsel concerning any disciplinary matters brought forth by private sector unions.

Advice and training: Our attorneys work with our clients to develop educational seminars that are customized to their members. We have conducted seminars with representatives from the DOL to ensure that union officials know how to protect the interests of their members.
